1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and BitInsight ("we," "us," or "our"), governing your access to and use of the website located at https://bitinsight.io and all related services, features, and content (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue use of the Service.

You represent and warrant that you are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater. If you are under 18 years of age, you are not permitted to access or use the Service under any circumstances.

Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. DESCRIPTION OF SERVICES

BitInsight is a cryptocurrency market data and analysis platform that provides informational resources to help users stay informed about the digital asset market. Our services include, but are not limited to:

Real-time cryptocurrency price comparison across major exchanges including Upbit, Binance, Bybit, OKX, Coinbase, and others
Kimchi premium tracking, which monitors the price differential between Korean cryptocurrency exchanges and global exchanges
On-chain data and metrics, including Bitcoin hashrate, mining difficulty, and transaction fee information sourced from Mempool.space
Derivatives and futures market data, including funding rates, open interest, and long/short ratios sourced from Binance
Whale transaction monitoring and alerts for large cryptocurrency transfers
AI-powered market trend analysis and sentiment reports, currently available for Bitcoin (BTC), powered by OpenAI
Community hub features allowing registered users to publish posts, leave comments, and interact with other users
Market indicators and charts, including cryptocurrency dominance trends, the Fear & Greed Index, total market capitalization, and related metrics

BitInsight is strictly an informational platform. We are not a financial advisor, broker, dealer, investment company, or any form of financial intermediary. We do not provide personalized financial advice, execute trades, hold custody of any assets, or facilitate any transactions on behalf of users.

The data and information presented on the Service are aggregated from various third-party sources, including cryptocurrency exchanges, public blockchain data providers (such as Mempool.space), market data aggregators (such as CoinGecko and Alternative.me), and AI models. While we strive to present accurate and up-to-date information, data may be subject to delays, interruptions, inaccuracies, or omissions. We do not guarantee the accuracy, completeness, timeliness, or reliability of any data displayed on the Service.

3. INTELLECTUAL PROPERTY

All content, features, and functionality of the Service, including but not limited to the BitInsight name, logo, website design, layout, user interface, graphics, text, images, software, code, and the selection and arrangement thereof, are the exclusive property of BitInsight or its licensors and are protected by applicable copyright, trademark, trade dress, patent, and other intellectual property or proprietary rights laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your personal, non-commercial informational purposes only. This license does not include the right to:

Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from the Service
Use any data mining, robots, scraping, crawling, or similar automated data gathering or extraction methods on the Service
Download, copy, or store any content systematically or in bulk from the Service
Use the Service or any content therein for any commercial purpose without our prior written consent
Remove, alter, or obscure any copyright, trademark, or other proprietary notices

Any use of the Service or its content not expressly permitted by these Terms is a breach of these Terms and may violate applicable intellectual property laws.

4. USER ACCOUNTS

To access certain features of the Service, such as the community hub, you may register for an account using Google OAuth authentication. By creating an account, you agree to the following:

You will provide accurate, current, and complete information during the registration process
You will maintain and promptly update your account information to keep it accurate, current, and complete
You are solely responsible for safeguarding your account credentials and for all activities that occur under your account
You will immediately notify us of any unauthorized use of your account or any other breach of security
You may only maintain one account per person; creating multiple accounts is prohibited
You will not share your account access with any other individual or entity

We reserve the right to suspend, disable, or terminate your account at our sole discretion, at any time, for any reason or no reason, including but not limited to a violation of these Terms. We are not liable to you or any third party for any suspension, disabling, or termination of your account.

5. USER-GENERATED CONTENT

The Service may allow you to create, submit, post, display, or share content, including but not limited to text, images, comments, and other materials (collectively, "User Content") through our community hub. You retain ownership of any intellectual property rights that you hold in your User Content.

By posting User Content on the Service, you grant BitInsight a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and providing the Service. This license continues even if you stop using the Service, to the extent your User Content has been shared with others who have not deleted it.

You represent and warrant that your User Content does not and will not violate these Terms or any applicable law. You agree that you will not post User Content that:

Is unlawful, fraudulent, deceptive, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Constitutes spam, unsolicited advertising, or promotional material
Involves market manipulation, pump-and-dump schemes, or coordinated efforts to artificially influence cryptocurrency prices
Provides misleading financial advice, false investment predictions, or fraudulent information designed to induce others to buy or sell cryptocurrencies
Infringes upon the copyright, trademark, trade secret, or other intellectual property rights of any third party
Contains personal or private information of another individual without their consent
Contains malicious code, viruses, or any other harmful technological components
Harasses, bullies, intimidates, or threatens any other user of the Service
Impersonates any person or entity, or falsely states or misrepresents your affiliation with a person or entity

We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content at our sole discretion and without notice for any reason, including but not limited to content that we determine violates these Terms or is otherwise objectionable. We are not responsible for the accuracy, completeness, appropriateness, or legality of User Content posted by users.

6. PROHIBITED ACTIVITIES

You agree that you will not engage in any of the following prohibited activities in connection with your use of the Service:

Attempting to gain unauthorized access to the Service, other user accounts, or any computer systems or networks connected to the Service through hacking, password mining, or any other means
Using any automated system, including but not limited to bots, spiders, scrapers, crawlers, or offline readers, to access the Service for any purpose, including data collection or extraction
Attempting to manipulate cryptocurrency markets through posts, comments, or any other content published on the Service, including coordinated pump-and-dump schemes or spreading false information to influence prices
Impersonating any person, entity, or organization, or falsely claiming an affiliation with any person, entity, or organization
Uploading, transmitting, or distributing any viruses, worms, trojans, ransomware, or any other malicious or destructive code
Circumventing, disabling, or otherwise interfering with security-related features of the Service, including features that prevent or restrict the use or copying of any content
Using the Service or any content therein for any commercial purpose, including selling, reselling, or redistributing data obtained from the Service, without our prior written consent
Interfering with, disrupting, or creating an undue burden on the Service, its servers, or the networks connected to the Service
Using the Service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Service
Using any information obtained from the Service to harass, abuse, or harm another person or entity
Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying algorithms of the Service
Engaging in any activity that violates any applicable local, national, or international law or regulation

Violation of any of these prohibitions may result in immediate termination of your account and access to the Service, and may also subject you to civil and criminal liability.

BitInsight offers AI-powered market trend analysis, currently available for Bitcoin (BTC), generated using OpenAI's language models. This AI analysis is provided as an additional informational resource and is subject to the following terms:

AI-generated content, including market analysis, sentiment assessments, trend predictions, and any other AI outputs, are produced by machine learning models and may be inaccurate, incomplete, misleading, or outdated
AI models generate responses based on patterns in training data and do not have real-time awareness of market conditions, breaking news, or other rapidly changing factors that affect cryptocurrency prices
AI-generated content does not constitute investment advice, financial guidance, or a recommendation to buy, sell, or hold any cryptocurrency
BitInsight does not guarantee the accuracy, reliability, completeness, or timeliness of any AI-generated content
AI analysis should be treated as one of many potential data points and should never be the sole basis for any investment or trading decision
AI models may exhibit biases, generate contradictory outputs, or produce outputs that appear confident while being factually incorrect
The AI features may be modified, suspended, expanded to additional cryptocurrencies, or discontinued at any time without prior notice

Users should exercise independent judgment and critical thinking when reviewing AI-generated content. You should not rely solely or primarily on AI analysis for any financial decision. The Service aggregates and displays data from various third-party sources to provide users with a comprehensive view of the cryptocurrency market. These third-party sources include, but are not limited to:

CoinGecko for market capitalization data, cryptocurrency metadata, and aggregated market statistics

We are not responsible for the accuracy, availability, completeness, timeliness, or reliability of any data provided by third-party sources. Third-party data may be delayed, inaccurate, or unavailable due to factors beyond our control, including exchange outages, API limitations, network latency, or data provider service interruptions.

The inclusion of any link does not imply endorsement, approval, or recommendation by BitInsight of the linked website, its products, or its services. The Service displays third-party advertisements served through the AADS advertising network and potentially other advertising partners. These advertisements help support the operation of the Service.

BitInsight is not responsible for the content, accuracy, legality, or any other aspect of third-party advertisements displayed on the Service. The presence of an advertisement on the Service does not constitute an endorsement, recommendation, or approval of the advertised product, service, company, or website by BitInsight.

You interact with and click on advertisements entirely at your own risk. BitInsight shall not be liable for any loss, damage, or harm arising from your interaction with any advertisement displayed on the Service, including but not limited to any transactions you enter into with advertisers.

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
Any warranty that the Service will be uninterrupted, timely, secure, or error-free
Any warranty regarding the accuracy, completeness, reliability, timeliness, or availability of any data, content, or information provided through the Service
Any warranty that the results obtained from the use of the Service will be accurate, reliable, or meet your requirements or expectations
Any warranty that defects in the Service will be corrected

Cryptocurrency market data displayed on the Service may be delayed, inaccurate, incomplete, or unavailable at any time. Exchange rates, prices, trading volumes, and other market data are sourced from third parties and may differ from actual real-time market conditions. We do not guarantee uninterrupted access to or operation of the Service. The Service may be unavailable due to maintenance, updates, technical issues, or factors beyond our control.

No information or advice, whether oral or written, obtained by you from BitInsight or through the Service shall create any warranty not expressly stated in these Terms.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BITINSIGHT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY OF THE FOLLOWING, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT BITINSIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES:

Any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind
Any loss of profits, revenue, business, savings, goodwill, or anticipated savings
Any financial losses arising from investment or trading decisions made based on, or influenced by, information, data, analysis, or AI-generated content obtained from the Service
Any loss of data, use, or other intangible losses
Any damages arising from unauthorized access to, alteration of, or destruction of your data or account
Any damages resulting from any interruption, suspension, or termination of the Service
Any damages arising from your reliance on any information, content, or data provided through the Service

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF BITINSIGHT FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO BITINSIGHT IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED US DOLLARS (USD $100.00).

The limitations set forth in this section shall apply regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if BitInsight has been advised of the possibility of such damage, and even if a limited remedy set forth herein is found to have failed of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

14. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless BitInsight, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your access to or use of the Service
Your violation of these Terms or any applicable law or regulation
Your User Content, including any claims that your User Content infringes the rights of any third party
Any investment, trading, or financial decisions you make based on or influenced by information obtained from the Service
Your interaction with any third-party advertisements, websites, or services accessed through the Service
Any misrepresentation made by you
Your negligent or wrongful conduct

This indemnification obligation shall survive the termination of these Terms and your use of the Service. BitInsight reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

15. TERMINATION

We may suspend, restrict, or terminate your access to the Service and/or your account at any time, for any reason or no reason, at our sole discretion, with or without prior notice or liability to you. Reasons for termination may include, but are not limited to, a breach of these Terms, a request by law enforcement or other government agencies, unexpected technical issues, or extended periods of inactivity.

Upon termination of your account or access to the Service, your right to use the Service will immediately cease. The following provisions of these Terms shall survive termination: Intellectual Property, Investment and Financial Disclaimer, AI-Generated Content, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive termination.

16. GOVERNING LAW

These Terms and any dispute or claim arising out of or in connection with them or their subject matter, formation, or validity (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles.

Any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the Seoul Central District Court (Seoul, Republic of Korea), and you hereby consent to the personal jurisdiction and venue of such court. You waive any objection to the exercise of jurisdiction over you by such court and to venue in such court.

Nothing in these Terms shall deprive you of any mandatory consumer protection rights under the laws of your country of residence that cannot be waived by agreement. If you are a consumer residing in the European Economic Area (EEA), United Kingdom (UK), or any other jurisdiction with mandatory consumer protection legislation, those protections shall apply to the extent required by applicable law, regardless of the governing law chosen in these Terms.

17. CHANGES TO TERMS

BitInsight reserves the right to modify, amend, or update these Terms at any time, at our sole discretion. When we make changes, we will update the "Last updated" date at the top of these Terms. We may also, at our discretion, notify users of material changes through a notice on the Service or via email.

Your continued use of the Service after the revised Terms have been posted constitutes your acceptance of and agreement to the updated Terms. If you do not agree to the updated Terms, you must stop using the Service immediately. We encourage you to review these Terms periodically to stay informed of any changes.

18. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent to the greatest extent possible.

The failure of BitInsight to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
